Acceptance of Sahabi that Muta'a is included in Marriage


Many a times we see that Ahlusunnah will try to prove prohibition of Muta'a on the grounds that it is not Marriage. But we see that a Sahabi included them in wives, and termed this process تزویج

Let us see two narrations in this regard

NARRATION 1

Abu Y'ala writes


رقم الحديث: 924

(حديث مرفوع) حَدَّثَنَا أَبُو خَيْثَمَةَ ، حَدَّثَنَا إِسْحَاقُ الأَزْرَقُ ، عَنْ عَبْدِ الْعَزِيزِ بْنِ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ ، عَنِ الرَّبِيعِ بْنِ سَبْرَةَ ، عَنْ أَبِيهِ سَبْرَةَ بْنِ مَعْبَدٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَوْمَ حَجَّةِ الْوَدَاعِ : " اسْتَمْتِعُوا مِنْ هَذِهِ النِّسَاءِ " ، قَالَ : وَالاسْتِمْتَاعُ عِنْدَنَا : التَّزْوِيجُ ۔۔۔۔۔۔۔

Sabra bin Ma'bad said that Holy Prophet asws told us on day of Hujjat ul Wida'a: Do Istimta'a (temporary marriage) with these women. And Istimta'a in Marriage for us...........

Researcher of the book, Sheikh Hussein Saleem Asad termed the chain Sahih

Keep in mind that incident of Sabra bin Ma'bad is quite well known, and many narrations on this issue have been included in Sahih Muslim where the entire incident is given. You can read it here on this link

And even in this narration, it has been clarified further that it was Muta'a


إِنِّي كُنْتُ أَذِنْتُ لَكُمْ فِي الْمُتْعَةِ

(Holy Prophet asws said) I had given permission to you for Muta'a

So, this narration clarifies two things

1- Istimta'a and Muta'a, both terms are used for the same process

2- Sabra bin Ma'bad accepted that it is marriage/ تزویج

NARRATION 2

Ahmad bin Hanbal writes in his Musnad, the same incident; I will be translation the relevant parts only


ثم أمرنا بمتعة النساء فرجعنا إليه فقلنا يا رسول الله انهن قد أبين إلا إلى أجل مسمى قال فافعلوا قال فخرجت أنا وصاحب لي علي برد وعليه برد فدخلنا على امرأة فعرضنا عليها أنفسنا فجعلت تنظر إلى برد صاحبي فتراه أجود من بردي وتنظر إلي فتراني أشب منه فقالت برد مكان برد واختارتني فتزوجتها عشرا ببردى فبت معها تلك الليلة فلما أصبحت غدوت إلى المسجد فسمعت رسول الله صلى الله عليه و سلم وهو على المنبر يخطب يقول من كان منكم تزوج امرأة إلى أجل

Sabra said that Holy Prophet asws then permitted us to do Muta'a with ladies. We came to him and told him : O Prophet asws! they are not willing except for a specific time. He replied: Do it then.......................That lady opted me. So I married her (فتزوجتها ) for 10 days..............We heard Holy Prophet saying on Pulpit: whosoever married (تزوج) a lady for specific time..............

Sheikh Shoaib ul Arnawut says

تعليق شعيب الأرنؤوط : إسناده صحيح على شرط مسلم رجاله ثقات رجال الشيخين غير الربيع بن سبرة فمن رجال مسلم

Chain is Sahih on terms of Muslim, Narrators are all thiqa and that of Sheikhain except Rabi'i bin Sabra who is narrator of Muslim only

CONCLUSION

The attempt on part of scholars of Ahlusunnah to prove prohibition of Muta'a from the verse of Quran ( إلاّ على أزواجهم ), is nullified by this saying of Sahabi, who used the same words of (فتزوجتها ) and ( التَّزْوِيجُ); and words of Holy Prophet using the words (تزوج امرأة إلى أجل)
